Separation VS Divorce

• 1) In case that a husband and wife(Both are Islam) are separated (a wife moves back to her family and a husband lives in his house.) and they are not yet coming to an agreement of divorce, does the Islam law state about the period of separation at all? For how long a couple is separated and that means they are automatically divorced?
  
  2) Is it possible for either of them to marry other person? Do they need to ask the permission from his separated wife/ her separated husband?

  i am 32 male i have 3 childeren my wife nad my mother does nt have the same attitude we live un a joint family system i am realy feed up from the day today querlling what can i do please responce
